Odebrecht signed a leniency agreement with the Public Prosecution Service and the Public Prosecutor’s Office of Peru on Saturday, December 8.The agreement is the most important milestone of a far-reaching and thorough collaboration process with the country’s authorities, which began two years ago. In this process, the company acknowledged its responsibilities, apologized to society and offered to make amends to the State for any civil damages incurred.
For Odebrecht, the agreement, signed according to legislation in force in Peru since March 12, 2018, symbolizes a new era in which the Peruvian courts, companies and state authorities have a model aligned with international collaboration and leniency good practices, which now foster improved relations between the public and private sectors in other countries.
In the specific case of the investigations underway in Peru, the object of collaboration by Odebrecht and its former executives in the country, the agreement also guarantees legal security of the investigations undertaken until now, and continued attention to the Peruvian Public Prosecution Service and society.
Odebrecht reiterates its commitment to honor the payment of compensation under the terms agreed with the Public Prosecutor’s Office of Peru, added to the responsibility taken with its workers, suppliers and creditors, linked to projects and investments in the country.
Odebrecht has gone through a restructuring process, implemented a rigorous compliance system throughout its global activities and seeks sustainable growth, taking part in projects that contribute towards the social and economic development of the countries in which it operates, with integrity, ethics and transparency. Since 2016, Odebrecht has been enhancing measures to improve its management in terms of Compliance and Governance. This includes independent members on its Board, outsourcing the Ethics Line, strengthening internal controls and adopting an extensive anticorruption training program. The company has also signed a leniency agreement with the Brazilian authorities and those of a further 6 countries – the United States, Switzerland, the Dominican Republic, Panama, Ecuador and Guatemala, and negotiations are underway in the other markets in which it operates.
